Cancellation Policy

Consumers have a 14-day right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item. To exercise your right of withdrawal, you must inform us (PremiumBags, ORO Retail GmbH, Junkers-Ring 4, 85098 Großmehring, Germany, hello@premiumbags.com, telephone: +49 (0) 8456-80807-0) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, though this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you post the goods before the end of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any diminished value of the goods if this is attributable to handling of the goods that goes beyond what is necessary to establish their nature, characteristics and functioning.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs. Such as, for example, engraved items, personalised items, custom-made items.

Voluntary return option 30 days after receipt of goods

In addition to the statutory right of withdrawal for consumers, we offer a voluntary return option for a total of 30 days from receipt of goods in accordance with the following provisions:

You may return the goods received within 30 days by post without giving any reason. The period begins upon receipt of the goods by you. To meet the deadline, it is sufficient to post the goods in good time.

However, a condition for exercising the voluntary return option is that you have only worn or tried on the goods for fitting purposes, as you would in a high street shop, and that you return the goods complete, in their original condition, undamaged and, where possible, in the original sales packaging.

Consequences of a return

In the event of a valid return, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If the service received and any benefits derived (e.g. benefits of use) cannot be returned or surrendered, or can only be returned or surrendered in part or in a deteriorated condition, the customer must compensate the seller for the loss in value. Compensation for loss of value shall only be payable for the deterioration of the goods and for benefits derived insofar as such benefits or deterioration are attributable to handling of the goods that goes beyond the examination of their properties and functionality. ‘Examination of properties and functionality’ refers to testing and trying out the goods in question, as is possible and customary in a high street shop. Items suitable for parcel post must be returned at the seller’s risk. Obligations to refund payments must be fulfilled within 14 days. The period begins for the customer upon dispatch of the item, and for the seller upon receipt thereof.

Return costs

Where delivery to Germany has been contractually agreed and you make use of the voluntary, contractual right of return, we shall voluntarily bear the costs of returning the goods where the value of the goods is 50.00 euros or more, provided the return is made from within Germany.

You must bear the direct costs of the return if the price of the item to be returned does not exceed €50.00.

If you are returning goods delivered from abroad, you must bear the direct costs of returning the goods from abroad.

Return labels

Without prejudice to your statutory rights, we provide you with return labels for your return within Germany. We will send you a link for a return label. You can hand in the return at a parcel shop of the respective provider in Germany.

The statutory right of withdrawal applicable to consumers is not affected by compliance with the rules governing the additional contractual right of return and remains in force independently of this. Both the aforementioned right of withdrawal and the other statutory warranty rights remain unaffected by the aforementioned provisions of the voluntary, contractually granted right of return.
